1. Acceptance of Terms

Welcome to Bookmancer ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the website and services available at bookmancer.app (the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Bookmancer is an AI-powered book recommendation platform. You answer a short questionnaire about your reading preferences, and our AI generates personalized book suggestions. The Service operates on a credit-based system: users receive free credits upon signup and may purchase additional credits as needed. Book recommendation cards include links to Amazon for easy purchasing.

3. User Accounts

3.1 Account Creation

  • You must be at least 16 years old to create an account
  • You must provide accurate and complete information when creating your account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You may sign in using Google, Microsoft, or a magic link sent to your email — your account is created automatically on first sign-in

3.2 Account Restrictions

  • Each account is for individual use only — shared accounts are not permitted
  • You may not create multiple accounts to circumvent usage limitations
  • You may not transfer your account to another person
  • We reserve the right to suspend or terminate accounts that violate these restrictions

4. Credits and Billing

4.1 Nature of Credits

Credits are a pre-paid license to use the Service. Credits are not virtual currency, stored-value products, digital assets, or any form of property. Credits have no cash value and cannot be redeemed for money, transferred to other users, or exchanged outside of the Service.

4.2 Credit System

  • Free Credits: All users receive 10 free credits upon account creation
  • Credit Packs: Additional credits may be purchased through credit packs at prices listed on our website
  • Usage: Each book recommendation search returns 5 personalized recommendations. The credit cost depends on the quality mode you select: Fast mode costs 1 credit per search, while High Quality mode costs 2 credits per search. If your preferences match a recent search, we may return a cached result at no credit cost
  • No Expiration: Credits do not expire and remain available as long as your account is active

4.3 Billing Terms

  • Credit purchases are one-time payments processed securely through Stripe. We do not store your payment card details
  • Credits are added to your account immediately upon successful payment
  • Prices are displayed in the currency shown on the purchase page. You are responsible for any applicable taxes
  • We reserve the right to change credit prices, the number of credits per search, or the available quality modes at any time. Changes will not affect credits already purchased

4.4 Refund Policy

All credit purchases are final and non-refundable. Because credits are delivered and made available for use immediately upon purchase, the digital content is considered fully delivered at the point of sale. By completing a purchase, you expressly acknowledge and consent to the immediate delivery of credits to your account, and you understand that this constitutes a waiver of any applicable withdrawal or cooling-off period under consumer protection laws, including:

  • Brazil (CDC Art. 49): The right of withdrawal does not apply because the digital service is fully delivered and made available for immediate use at the time of purchase
  • EU/EEA (Consumer Rights Directive Art. 16): By agreeing to immediate delivery of digital content and acknowledging that this begins the performance of the service, you waive the 14-day right of withdrawal as permitted under EU law

If you experience a technical issue that prevents you from receiving credits after a successful payment, please contact us through our contact page and we will resolve the issue promptly.

4.5 Credit Forfeiture and Service Changes

  • If you delete your account, all unused credits are permanently forfeited
  • If we terminate your account for violation of these Terms, unused credits are forfeited
  • Service discontinuation: If we choose to discontinue the Service entirely, we will provide at least 90 days' notice and either issue proportional refunds for unused purchased credits or extend the Service availability for a period sufficient to use remaining credits

5. AI-Powered Recommendations

Our recommendations are generated by artificial intelligence using a third-party large language model (LLM) provider. By using the recommendation feature, you acknowledge and agree that:

  • No Guarantee of Accuracy: AI-generated recommendations may contain errors, including references to books that do not exist, incorrect author attributions, or inaccurate book descriptions
  • Not Professional Advice: Recommendations do not constitute professional literary criticism, educational guidance, or any form of professional advice
  • User Responsibility: You are solely responsible for your decision to purchase, read, or act on any recommended book. We are not responsible for the content of recommended books or your satisfaction with them
  • Content Restrictions: You agree not to use the recommendation form to input illegal, harmful, abusive, or otherwise inappropriate content. We reserve the right to filter or block AI outputs that violate our content policies
  • Sensitive Information: Do not include sensitive personal information (health data, financial details, government identifiers) in the recommendation form. The form is designed exclusively for reading preferences

Book recommendation cards include links to Amazon for purchasing. As an Amazon Associate, Bookmancer earns a small commission from qualifying purchases made through these links. This commission does not affect the price you pay.

When you click an Amazon link, you are redirected to Amazon's platform and become subject to Amazon's terms and privacy policy. You are always free to purchase books from your local bookshop, library, or any retailer you prefer.

7. Acceptable Use

7.1 Permitted Uses

You may use our Service to:

  • Receive personalized book recommendations based on your preferences
  • Save and organize recommendations into reading lists
  • Share and republish the recommendations you receive
  • Purchase and use credits according to these Terms

7.2 Prohibited Uses

You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated scripts, bots, or other means to access the Service excessively
  • Interfere with or disrupt the Service, servers, or networks
  • Attempt to reverse engineer, decompile, or extract our recommendation algorithms
  • Use the Service to distribute spam, malware, or harmful content
  • Submit illegal, abusive, or harmful content through the recommendation form or contact form
  • Violate any applicable laws or regulations

8. Intellectual Property

8.1 Your Content

  • You are free to share, republish, or use your recommendations in any way you choose
  • We do not claim ownership of your reading preferences, questionnaire responses, or recommendations you receive
  • AI-generated recommendation text may not be copyrightable under applicable law and is provided to you under a license to use freely

8.2 Our Content

  • The Bookmancer platform — including our website design, branding, and proprietary technology — is owned by us and protected by intellectual property laws
  • Our trademarks, logos, and brand elements may not be used without our written permission
  • You may not copy, modify, or create derivative works of our Service

8.3 Third-Party Content

  • Book metadata (titles, author names, descriptions, cover images) displayed in recommendations comes from third-party sources and belongs to their respective owners
  • Amazon links, book covers, and other third-party content are subject to their respective terms and licenses

9. Service Availability and Disclaimers

9.1 Service Availability

  • We strive to maintain Service availability but do not guarantee uninterrupted access
  • We may temporarily suspend the Service for maintenance, updates, or technical improvements
  • We reserve the right to modify or discontinue features with at least 30 days' notice for material changes

9.2 Recommendation Disclaimers

  • Recommendations are AI-generated suggestions based on your stated preferences and may not always match your taste
  • We do not guarantee the accuracy, quality, availability, or existence of recommended books
  • Book metadata (titles, authors, descriptions) may contain errors as it is sourced from third-party databases
  • Recommended books may not be available in your region or language
  • Book recommendations are for informational and entertainment purposes only

9.3 Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, third-party service outages (such as Google, Cloudflare, Stripe, or AWS failures), internet disruptions, cyberattacks, or power failures.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you also agree to our Privacy Policy.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE
  • OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR DAMAGES RESULTING FROM AI-GENERATED RECOMMENDATIONS, THIRD-PARTY SERVICES, OR YOUR PURCHASE OR USE OF RECOMMENDED BOOKS

Note: Some jurisdictions (including Brazil under the Consumer Defense Code and EU member states under consumer protection directives) do not allow certain limitations or exclusions of liability. In such jurisdictions, the above limitations apply only to the extent permitted by applicable law.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your deliberate misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Fraudulent or illegal activity conducted through your account

Note: This indemnification clause does not apply where prohibited by consumer protection laws in your jurisdiction, including under Brazil's Consumer Defense Code (CDC) and EU consumer protection regulations.

13. Account Termination

13.1 Termination by You

  • You may delete your account at any time through your account settings
  • Upon deletion, your saved books, reading preferences, and recommendation history are permanently removed. Core account records are anonymized and retained briefly for legal compliance before permanent deletion (see our Privacy Policy for details)
  • All unused credits are permanently forfeited upon account deletion
  • Deletion is irreversible and cannot be undone

13.2 Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms or our Privacy Policy
  • Use the Service in a way that could harm us, other users, or third parties
  • Engage in fraudulent, abusive, or illegal activities

We will make reasonable efforts to notify you before or at the time of termination, except where immediate action is necessary to protect the Service or other users.

13.3 Effect of Termination

  • Upon termination, your right to use the Service immediately ceases
  • All data associated with your account will be handled according to our Privacy Policy
  • Sections that by their nature should survive termination will remain in effect, including Limitation of Liability, Indemnification, Intellectual Property, and Governing Law

14. Modifications to Terms

We may update these Terms from time to time. For material changes, we will:

  • Provide at least 30 days' notice before changes take effect
  • Post the updated Terms on our website and update the "Last Updated" date
  • Send a notification to your registered email address for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and may delete your account.

15. Governing Law and Disputes

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict of law principles.

Informal Resolution: Before initiating any formal legal proceedings, you agree to contact us through our contact page and attempt to resolve the dispute informally for at least 30 days.

Jurisdiction: In accordance with Brazil's Consumer Defense Code (CDC), any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the consumer's domicile, as provided by applicable law.

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. General Provisions

  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or the right to enforce it in the future
  • Assignment: We may assign or transfer these Terms and our rights to an affiliate or successor. You may not assign your rights or obligations under these Terms
  • Notices: We will send official notices to the email address associated with your account. You are responsible for keeping your email address current
  • Electronic Communications: By using the Service, you consent to receiving communications from us electronically. You agree that electronic communications satisfy any legal requirement for written communications
  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bookmancer regarding your use of the Service and supersede all prior agreements
